An Elma man has been charged with one count of vehicular homicide after a deadly October crash in the Capitol State Forest.

According to charging documents, Jesse Robert Kwiatkowski, had been drinking and had THC, the intoxicating compound from marijuana, in his blood about 9 p.m. Oct. 20 when he was driving Conny Brown on D Line road in Capitol State Forest. He is accused of losing control of his vehicle, a Ford pick-up, while rounding a corner. Brown, 25, of Oakville, was the only passenger.

Grays Harbor Sheriff’s Office and Oakville Fire Department personnel arrived on scene and determined that Brown was dead. Kwiatkowski was being treated in an ambulance when Washington State Patrol troopers arrived.

Kwiatkowski told troopers that “he was driving around, drove too fast around a corner, the vehicle left the roadway and hit the tree,” charging documents state. He admitted to drinking earlier that day. Blood tests also determined that he had consumed marijuana.

On Dec. 5, Kwiatkowski pleaded not guilty to the charge of vehicular homicide. He is out on $50,000 bail pending a March trail. He is not to leave Western Washington, possess firearms or consume intoxicating beverages or marijuana.
