PROPOSED MITIGATED DETERMINATION OF NONSIGNIFICANCE
CITY OF WESTPORT, WASHINGTON
Description of Proposal: Construction of an approximately 615 linear feet of an 8 foot wide concrete trail adjacent to the southern edge of the parking lot at Westhaven State Park. The trail will be located in the previously filled boarder along the edge of the current parking area. The trail will replace the previously construction portion of trail that was located on the north side of the parking area. This trail was partially destroyed by erosion from storm events. The remainder was buried by sand placed by the Corps of Engineers as a measure to slow down further erosion in the area. The proposed trail will reconnect the ends of the existing trail that extends south the Westport Light State Park, and east to the Westport Marina. The trail will consist of approximately 4 inches of concrete on top of approximately 1 inch of packed gravel.

Therefore an Environmental Impact Statement is not required under RCW 43.21C.030(2)(C). This information is available to the public on request.
This determination is based on a presumption that this project will include all mitigation measures proposed to be implemented by the applicant and will conform to all applicable standards and regulations. Should any mitigation measure be removed by the applicant, be infeasible, or be held to be invalid or unconstitutional, a new threshold determination may be required. Among other standards, this project is subject to and must conform to the Comprehensive Plan, Land Use, Zoning, Public Works Standards, Natural Resource Lands and Critical Areas, and Flood Plains. In addition, this project shall conform with and, unless expressly stated, any subsequent permits shall automatically incorporate with or without reference the conditions set forth below.
Comments regarding this proposed Mitigated Determination of Non-Significance (MDNS) should be directed to the City Administrator at the address above. This MDNS is not a permit. This MDNS is issued under Washington Administrative Code 197-11-350(2). This MDNS is also issued under 197.11.340(2); the lead agency will not act on this proposal for 15 days from the date of issue. Comments must be submitted by October 09, 2007.
SEPA-BASED CONDITIONS AND MITIGATING MEASURES:
1. Wetland: Impacts to wetland areas outside of the proposed construction areas shall be avoided during and after construction. Prior to construction, the contractor shall provide an erosion control plan for review and approval by the City. No side casting or staging of fill or construction materials in either the wetlands or associated wetland buffer areas is authorized. No clearing of vegetation in the remaining wetland area shall be allowed.

Description of Proposal: Construction of an approximately 3300 Square foot two-story single family residence with attached garage on a previously platted 12,900 square foot residential lot in the City of Westport. Approximately 9,541 sq. ft. of the lot is covered by category III wetlands. The remaining 3,359 sq. ft. of the lot is upland and consists of the existing roadway and drainage ditch. The applicant proposes to fill approximately 5,320 sq. ft. of the lot for the development of the structure which includes the residence and a single car attached garage, as well as a 15 ft wide driveway connecting to the existing road, and utility connections. The filled are will create a 12 foot buffer along the boundary between the disturbed wetland and the residence. The fill will consist of approximately 400 cu. yards of clean sand.

SEPA-BASED CONDITIONS AND MITIGATING MEASURES:
1. Stormwater: The applicant shall submit a stormwater drainage design with the fill and grade permit application that has been approved by a licensed engineer and that certifies the proposed fill will not impact adjacent properties. The design will include any additional mitigation measures required by the engineer to prevent negative impacts. Stormwater runoff from impervious surfaces shall be infiltrated on site, or directed away from the adjacent wetlands and to the existing ditches.

3. Buffer: Prior to issuance of a building permit, the applicant shall submit for approval a planting plan for the proposed buffer area. The applicant shall install informational signs or split rail or equivalent fencing along the border between the buffer and structure to protect the buffers.

WHEREAS, since the adoption of the budget for the year 2007, certain income and expenses have become known to the Council which were not capable of prediction at the time of the budget adoption;
THEREFORE, IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF COSMOPOLIS:

Grays Harbor County will apply to the Superior Court in November or December 2007 for a judgment foreclosing its lien for taxes and an order to sell the property against which judgment is rendered. If you fail to answer or pay the amount due, default judgment will be entered against the property foreclosing the lien for taxes, interest, penalties, and foreclosure costs against the land and premises described herein and in the attachments to the Certificate of Delinquency and the Amended Certificate of Delinquency on file herein. A default judgment is one where Grays Harbor County is entitled to have the application for judgment foreclosing the tax lien granted because you have not responded. The judgment would be against the property and not a personal judgment against you.
6. On the attached “Exhibit A” there is listed the property tax number of the property that you may own or in which you have some legal interest. Please make reference to the tax parcel number in your answer, notice of appearance, or any other response or correspondence concerning this foreclosure action.
7. If judgment is rendered against the property, either by default or after a hearing by the court, the property will be ordered to be sold. The property against which judgment is rendered will be sold, unless redeemed prior to the date of sale at a public auction commencing at 9:00 a.m. on Friday, December 7, 2007. The public auction will be held at the Montesano City Hall, 2nd Floor Meeting Room, 112 North Main Street, Montesano, Washington.
8. Important – Redemption Rights. The property may be redeemed from foreclosure, and sale of the property avoided, by paying the delinquent taxes, interest, penalties, and foreclosure costs prior to the day of the public auction (on or before December 6, 2007). The payment must be by cash, cashier’s check or money order. The right to redeem the property expires at the close of business the day before the public auction. There is no right of redemption on the day of or after the public auction, except as provided under RCW 84.64 for mentally incompetent persons and minors.
9. Important – Right to Surplus Sale Proceeds. If the property is not redeemed from foreclosure and you are the recorded vested owner of the property on the day upon which the certification was filed (July 5, 2007), you are entitled to any sale proceeds which exceed the taxes, interest, penalties, and foreclosure costs.
10. Exemption for Elderly and Disabled. This action will not be continued against your property if you are eligible for deferral of taxes under RCW 84.38 due to age or disability and file a declaration to defer taxes in accordance with the requirements of that chapter. The Foreclosure Department of the Grays Harbor County Treasurer’s Office can assist you in filing a declaration if you call (360) 249-3751 ext. 382. You will be advised to contact the Grays Harbor County Assessor’s Office for the documents necessary to apply for deferral of the taxes, but the Treasurer’s Office must be contacted for a declaration form in order to remove you property from the tax sale.
11. Interest accrues at the rate of 12% per year. A penalty of 8% on the 2007 property tax will be assessed December 1, 2007, if the property is not redeemed before that date.
12. The claim must be presented within the later of: (1) thirty days after the personal representative served or mailed the notice to the creditor as provided under RCW 11.40.020(1)(c); or (2) four months after the date of first publication of this notice. If the claim is not presented within this time frame, the claim is forever barred, except as otherwise provided in RCW 11.40.051 and 11.40.060. This bar is effective as to claims against both the decedent’s probate and non-probate assets.
