PROPOSED MITIGATED DETERMINATION OF NONSIGNIFICANCE
CITY OF WESTPORT, WASHINGTON
Description of Proposal:
Construction of 26 detached town house style condominiums on
a 2 acres parcel in the City of Westport. The parcel is mostly
uplands, based on an evaluation by a biologist. A category three
wetland is located to the west of the site. Approximately .007
acres of this wetland extend onto the site. The wetland itself
will not be impacted by the proposed development however the
applicant does propose to reduce the width of the buffer to 15
feet in two areas. The applicant proposes to mitigate for this
reduction by the use of buffer averaging and enhancement of the
entire buffer are through planting. Although excavation will
be required for roadways and infrastructure, approximately half
the parcel will be left undisturbed and as much existing vegetation
will be left as possible. The project will include access roadways,
walkways, parking areas, and utilities. The applicant proposes
to improve Hancock Ave with frontage improvements. The applicant
proposes to infiltrate all stormwater on site through the use
of collection basins and porous pavement.

Threshold Determination: The lead agency for this proposal

WYNOOCHEE RIVER BANK PROTECTION PROJECT

Mitigated Determination of Non-Significance (MDNS)
Description of Proposal: The placement of large
woody debris (LWD) using the Washington State Department of Fish
and Wildlife's (WDFW) Integrated Streambank Protection Guidelines
(ISPG) Roughness Tree concepts. Work will be comprised of planting
trees and placing logs, stumps and riprap along approximately
400 feet of bank to provide bank line protection and enhance
fish habitat. This project will stabilize an eroding and unstable
bank line area of the Wynoochee River by employing bio-engineering
techniques per the ISPG concepts through the placement of roughness
trees (LWD) that will be anchored in place using 'deadman anchors',
such as large rip rap, with piling placed landward away from
the River's ordinary high water line (OHWM), and using metal
cables or other appropriate anchoring techniques to secure the
trees in place. The logs will be set into the water using "chokers"
attached to an excavator bucket and/or a bucket with attached
thumb, the excavator will work from the bank line and no equipment
will enter or operate below OHWM and/or enter the water. Both
the setting of the logs and the anchoring of the logs will be
undertaken prior to August 31, 2007 to avoid any adverse impacts
to fish (per WDFW In-water Work Window for the main stem of the
Wynoochee River.)
This proposal is a short-term project intended to address
an emergency condition anticipated to occur during the winter
months of late 2007 and early 2008; the condition would place
both private property, including residences, and public infrastructure
at risk.
Grays Harbor County Code (GHC) Chapter 18.04.080 and Washington
Administrative Code (WAC) Chapter 197-11-800(3)(b) require an
environmental threshold determination for the installation of
reconstruction and maintenance of shoreline protection measures.

EARTH: To mitigate for probable significant adverse
impacts from project activities resulting in sediment transport:
·Temporary erosion and sediment control practices (TESCP)
shall be installed prior to the start of project activities and
shall remain in place until the project is completed. The measures
shall be consistent with Best Management Practice (BMP) C101,
BMP C120, BMP C180, BMP C201, and BMP C230 as contained in the
2005 Washington State Department of Ecology's Stormwater Management
Manual for Western Washington.
·Final project practices shall be reviewed and approved
by Grays Harbor County and the Washington State Department of
Fish and Wildlife prior to the start of the project activities.
WATER: To mitigate for probable significant adverse
impacts from project activities to water quality:
·Fuel spill prevention measures shall be implemented
during project activities. The measures shall be consistent with
the BMP contained on page 2-43 of the 2005 Washington State Department
of Ecology's Stormwater Management Manual for Western Washington.
·Final project measures shall be reviewed and approved
by Grays Harbor County and the Washington State Department of
Fish and Wildlife prior to the start of the project activities.
PLANTS AND ANIMALS: To mitigate for probable significant
adverse impacts from project activities to plants and animals:
·Project activities waterward of the ordinary high water
mark (OHWM) for the Wynoochee River shall be undertaken within
the time period of prior to August 31, 2007 or as otherwise authorized
by the Washington State Department of Fish and Wildlife's Hydraulic
Project Approval (HPA) for the proposal.
This MDNS is issued under the authority of GHC Chapter 18.04.120,
WAC Chapter 197-11-350, and RCW Chapter 43.21C.135. Written
