The successful bidder shall be determined by the highest responsible bonus bid received. The minimum acceptable bonus bid shall be $6.00 per acre. Annual rental rates are fixed and are not subject to bidding. The term of the lease shall be for a period of 10 years. The annual rental rates shall be $2.00 per acre for years 1-5 and $5.00 per acre for years 6-10.
On or before November 16, 2007 by not later than 10:00 AM, each prospective lessee must submit their sealed bid, on a form provided for that purpose, enclosed in a sealed bid envelope also provided. A bid deposit in the amount of 100 per cent of the bonus bid in the form of a certified check shall be included with the sealed bid. Upon award of the lease, the successful bidder must pay the first years annual rent in the amount of $11,296.00. The annual rental payment shall be submitted within 10 days of the day of the auction. The anniversary date for the lease shall be the date of execution of the lease agreement and not the date of the auction.

It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly the above-named County has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190).
The reasons for such decision not to prepare such statement are as follows: The project will not adversely affect the 100-year-floodplain. The building is not a historic structure.
An Environmental Review Record for this project has been made by the above-named County, which documents the environmental review of the project and more fully sets forth the reasons why such statement is not required.
This Environmental Review Record is on file at the above address and is available for public examination and copying upon request at the Department of Public Services, 100 W. Broadway, Suite 31, Montesano, WA 98563 between the hours of 8:00 and 4:30.

PUBLIC COMMENTS ON FINDING OF NO SIGNIFICANT IMPACT
All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the County to the office of the undersigned. All comments must clearly specify which decision they object to – the Finding of No Significant Impact or the Request for Release of Funds. Such written comments should be received at the address specified on or before November 26, 2007. All such comments so received will be considered and the County will not request the release of federal funds or take any administrative action on the project on/or before the date specified in the preceding sentence.
RELEASE OF GRANT FUNDS
Grays Harbor County will undertake the project described above with Community Development Block Grant (CDBG) funds from the Washington State Department of Community, Trade and Economic Development (CTED) under Title I of the Housing and Community Development Act of 1974, as amended. Grays Harbor County is certifying to CTED that Grays Harbor County and Albert A. Carter, in his official capacity as Chairman of the Board of County Commissioners, consent to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making and action, and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval Grays Harbor County may use the CDBG funds and CTED will have satisfied its responsibilities under the National Environmental Policy Act of 1969 and other environmental responsibilities listed in 24 CFR Part 58. CTED will accept an objection to its approval only if it is on one of the following bases: a) that the certification was not in fact executed by the certifying officer or other officer of applicant approved by CTED; or b) that applicant’s environmental review record for the project indicates omission of a required decision finding or step applicable to the project in the environmental review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to CTED/CDBG Program Staff at 906 Columbia Street SW, PO Box 48350, Olympia, Washington 98504-8350.
