SYNOPSIS OF ORDINANCE NO. 1102

AN ORDINANCE ADOPTING A SUPPLEMENTAL BUDGET FOR THE YEAR 2007; and AMENDING ORDINANCE 1093 TO THE EXTENT INCONSISTENT HEREWITH.

On the 7th day of December, 2009, the City Council of the City of Elma adopted Ordinance Number 1102.  The intent and purpose of the Ordinance in adopting the above-referenced Ordinance was to adopt a Supplemental Budget to bring the revenues and expenditures for the year 2009, as anticipated in the original Budget Ordinance #1093, into consistency with those which were actually received and expended.  The adjustments totaled $1,449,782.00.  The budget remained balanced.

Further, it established the compensation levels for employees and officials of the City subject to modification as the result of certain continuing labor negotiations.   On the 7th day of December, 2009, the City Council of the City of Elma adopted Ordinance Number 1101.  The intent and purpose of the Ordinance was to adopt a budget for the calendar year 2010.  The budget was balanced calling for estimated revenues and expenditures in the amount of $6,386.416.00.  The budget was adopted through allocation to various funds and is not a line item budget.

STATE ENVIRONMENTAL POLICY ACT
Grays Harbor County PUD Power Line Extension Project
 Mitigated Determination of Non-Significance (MDNS)    
Development Case 2009-1269
Description of Proposal: The establishment of a private underground electrical power supply to eleven (11) forty-acre lots near the Ocean City region of unincorporated Grays Harbor County. The project includes (a) the installation of approximately 7,600-liner-feet of new 7,200 volt power cable and (b) installation of nine (9) vaults to distribute power to the individual tracts of land. The power cable and placement installation includes the following:
Placing of Cable
The primary cable shall be buried in the ground at a minimum depth of 36 inches (42 inches where joint with telephone) by plowing or trenching or combination of both as shown on the District work sketch.  Deeper placement may be required in specific areas as shown on the work sketch.
Trenching and Back Fill
Trench depth for cable shall be a minimum of 36 inches (or more, as specified in the work sketch) cover over the cable or conduit and minimum width shall be 5 inches as measured at the bottom of the trench.
  Back fill of sand or approved native material shall be made before and after placing the cable such that there will be a bedding and cover for the cable.  No stones or debris which might damage the cable shall be allowed to remain in the bed or cover. Bed and cover shall be a minimum of 12 inches thick or as directed by the District's designated representative. Compaction of back fill materials shall be 80 percent of original density, or as required by the State Department of Transportation or Grays Harbor County, depending on jurisdiction.
Splicing Areas
The splice trench shall be a minimum of 4 feet in depth, 4 feet in width and 12 feet long, and placed such that the splicing crew can make the splice in the center of this trench. Upon completion of the splice, the contractor shall bed, cover, and back fill as previously described under trenching and back fill.
Finished Grades
Upon completion of all back fill supplied by the contractor during the placement of cable, the right-of-way shall be restored to a condition at least as good as it was previous to commencement of work to the complete satisfaction of the District's designated representative. Any subsequent restoration costs shall be solely at the contractor's expense.
Culverts
The cable must be carefully removed from the chute and back hoed in around or under the culvert as specified in the work sketch. Cutting and splicing the cable for culvert crossings is permissible only if specified in the work sketch. Cable should be placed a minimum of 18 inches below culvert bottom or as specified on the work sketch.
  Cable must be carefully rechuted and held while the plow is slowly started to avoid pulling slack out of the culvert crossing.
  Grays Harbor County Code (GHC) Chapter 18.04.080 and Washington Administrative Code (WAC) Chapter 197-11-800(23) require an environmental threshold determination for the installation of utility related actions on lands covered by water.

Lead Agency: Grays Harbor County
Findings: Grays Harbor County, acting as lead agency pursuant to WAC Chapter 197-11-926(1), has determined that this proposal does not represent a probable significant adverse impact on the environment provided that the attached mitigating measures are conditions of permit issuance. This decision is based upon a review of the completed environmental checklist and other information on file and available for review Monday through Friday from 8:00 a.m. to 5:00 p.m. in the Planning and Building Development Division on the third floor of the Grays Harbor County Administration Building located at 100 West Broadway Avenue in the City of Montesano. An Environmental Impact Statement is not required for this proposal pursuant to the Revised Code of Washington (RCW) Chapter 43.21C.030.
  The following mitigating measures are assigned to this proposal pursuant to the authority granted under GHC 18.04.120, RCW Chapter 43.21C.135, and WAC Chapter 197-11-350: 
EARTH. To mitigate for probable significant adverse impacts from project activities resulting in sediment transport:
* Erosion and sediment control practices (ESCP) shall be installed prior to the start of project activities and shall remain in place until the project is completed. The measures shall be consistent with Best Management Practice (BMP) C101, BMP C120, BMP C180, BMP C201, and BMP C230 as contained in the 2005 Washington State Department of Ecology's Stormwater Management Manual for Western Washington.
  Final project practices shall be reviewed and approved by Grays Harbor County prior to the start of the project activities. 
WATER. To mitigate for probable significant adverse impacts from project activities to water quality:
* The applicant shall not fill, divert, or alter natural streams, drainage channels, and/or wetlands.
AIR. To mitigate for probable significant adverse impacts from project activities to air quality:
* Dust control measures shall be implemented during project activities. The measures shall be consistent with BMP C140 and the BMP contained on page 2-16 of the 2005 Washington State Department of Ecology's Stormwater Management Manual for Western Washington.
   Final project measures shall be reviewed and approved by Grays Harbor County prior to the start of the project activities. 
ENVIRONMENTAL HEALTH. To mitigate for probable significant adverse impacts from the development to the built environment:
* Fuel spill prevention measures shall be implemented during project activities. The measures shall be consistent with the BMP contained on page 2-43 of the 2005 Washington State Department of Ecology's Stormwater Management Manual for Western Washington.
  Final project measures shall be reviewed and approved by Grays Harbor County prior to the start of the project activities.  During construction, all releases of oils, hydraulic fluids, fuels, other petroleum products, paints, solvents, and other deleterious materials must be contained and removed in a manner that will prevent their discharge to waters and soils of the state.  The cleanup of spills shall take precedence over other work.
LAND AND SHORELINE USE. To mitigate for probable significant adverse impacts from project activities to historic and cultural preservation:
* Project activities shall cease immediately in the event that any cultural, historic, archeological, or scientific presence is discovered during project activities. Project activities shall not resume until approval to proceed is received from the Quinault Indian Nation and the Washington State Department of Archeology and Historic Preservation.  
  This MDNS is issued pursuant to the authority of GHCC 18.04.120, WAC 197-11-350, and RCW 43.21C.135. Grays Harbor County will not act on this fill and grade proposal for a minimum of 14-days. Written comments must be submitted to the Responsible Official at the address listed below by December 31, 2009
  Any person aggrieved by this threshold determination may file an appeal in Superior Court, pursuant to the Washington State Land Use Petition Act RCW 36.70C, within 21-days from (a) the date the Grays Harbor County Building Official issues the fill and grade permit, or (b) if appealed to the Grays Harbor County Building Codes Advisory Council, the date of final decision by the Council regarding such appeal, whichever is later.

Each bid or proposal must be accompanied by cash, bond, or a certified check, payable to the order of the Treasurer of the City of Westport for the sum of not less than five percent (5%) of said bid or proposal and none will be considered unless accompanied by such deposit, to be forfeited to the City of Westport in the event the successful bidder shall fail or refuse to enter into a Contract with the City for the making and construction of the aforesaid improvement.
  All bids or proposals must be in writing on the form bound in the Specifications, sealed, and filed with the Clerk of the City on or before the day and hour mentioned above.
  Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this project, and that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin. 
  The City of Westport encourages participation in all of its contracts by M/WBE firms certified by the office of Minority and Women's Business Enterprises (OMWBE).  Participation may be either on a direct basis in response to this solicitation or as a subcontractor to a Bidder/Proposer.  No preference will be included in the evaluation of bids/proposals, no minimum level of M/WBE participation shall be required as a condition for receiving an award, and bids/proposals will not be rejected or considered non-responsive on that basis.  The voluntary M/WBE goal established for this project is 10% MBE and 6% WBE participation.  
  The City of Westport reserves the right to reject any and all bids and to waive technicalities or irregularities, and after careful consideration of all bids and factors involved, make the award to best serve the interests of the City of Westport.      
  This project is partially funded by the Washington State Transportation Improvement Board, the City of Westport, Washington State Dept. of Ecology, and Grays Harbor Transit.
