III.
The defaults for which this foreclosure is made are as follows:

  Failure to pay when due the following amounts which are now in arrears:
  Ten monthly payments of $1,237.88 from October 15, 2008, through, and including, July 15, 2009, for a total of $12,378.80.
  Ten late charge payments of $61.89 for payments not made within 10 days of the due date from October, 2008, through and including July, 2009, for a total of $618.90.
  General property taxes for 2007 in the amount of $1,798.94, plus interest and penalties, in 2008 in the amount of $1,632.60, plus interest and penalties, and the first half of 2009 in the amount of $766.94, plus interest and penalties.
  Failure to pay for insurance in the amount of $433.46, which amount was paid by Bank of the Pacific and must be reimbursed.
IV.
  The sum owing on the obligation secured by the Deed of Trust is:  Principal balance of $138,391.64, together with interest as provided in the note or other instrument secured from the 23rd  day of November, 2005, and such other costs and fees as are due under the note or other instrument secured and as are provided by statute.
V.
  The above-described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute.  The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on the 13th day of November, 2009.  The defaults referred to in paragraph III, together with any subsequent payments, late charges, advances, costs, and fees thereafter due, must be cured by the 2nd day of November, 2009, (11 days before the sale date), to cause a discontinuance of the sale.  The sale will be discontinued and terminated if at any time on or before the 2nd day of November, 2009, (11 days before the sale date), the defaults as set forth in paragraph III, together with any subsequent payments, late charges, advances, costs, and fees thereafter due, are cured, and the Trustee's fees and costs are paid.  The sale may be terminated any time after the 2nd day of November (11 days before the sale date), and before the sale by the Grantor or the Grantor's successor in interest or the holder of any recorded junior lien or encumbrance by paying the entire principal and interest secured by the Deed of Trust, plus costs, fees and advances, if any, made pursuant to the terms of the obligation and/or Deed of Trust, and curing all other defaults.

The lead agency issued a Proposed Mitigated Determination of Non Significance for this proposal on September 28, 2009.
Project Description:
  Construction of an approximately 2405 square foot single family residence with attached garage on a on a previously platted 10,200 square foot residential lot in the City of Westport.
  Approximately 8,971 sq. ft. of the lot is covered by category III wetlands.  The remaining 1,229 sq. ft. of the lot is upland and consists of grasses and brush.  The applicant proposes to fill approximately 3,928 sq. ft. of the lot for the development of the structure which includes the residence and an attached garage, as well as a 20 ft. wide driveway connecting to the existing road and utility connections.  The filled area will create a building pad with normal slopes along the boundary on the west boundary pad with normal slopes along the boundary on the west boundary of the building.  A minimum of a 12 foot buffer will be maintained round the remainder of the wetland boundary.  The fill will consist of approximately 300 cu. Yards of clean sand.

Hearing:
A public hearing will be held by the City of Westport Planning Commission on November 17, 2009 commencing at 6:00 p.m. in the Westport City Council Chambers at 506 North Montesano Street, Westport, Washington.  The purpose of the public hearing is to give citizens the opportunity to testify to the Planning Commission regarding the above proposal, including consideration of the environmental impact of the proposal together with the environmental documents.
