Notice is hereby given that the Grays Harbor County Noxious Weed Control Board will hold a public hearing to adopt the 2008 Grays Harbor County Noxious Weed List on February 13th, 11:30 AM at the WSU Cooperative Extension Meeting Room . All members of the public are welcome to make suggestions regarding the noxious weed list. This list categorizes weeds into three major classes – A, B, and C - according to the seriousness of the threat they pose to Grays Harbor county or a region of the county.

NOTICE IS HEREBY GIVEN that Terry Graham, represented by Mike Daniels of Pacific International Engineering PLLC., has submitted an application for a 23-lot long subdivision permit pursuant to Grays Harbor County Code Title 16. Furthermore, a special use permit is needed to cluster the lots to the more developable portions of the property, while maintaining the overall density requirement of one unit per five acres. The permit would allow the applicant to subdivide approximately 123-acres of land into twenty-two (22) residential lots, with one (1) undevelopable open-space tract. The proposed lots range in size from 2.2-acres to 9.3-acres. Included in the proposal are improvements to Calder Road and construction of private roads within the subdivision. All lots are proposed to be served by individual wells and have individual on-site septic systems.

The project is proposed Northwest of the city of Elma and north of Calder Road, on the property having Assessor parcel #’s 180628420000, 180628410010 and 741502600002, within the Southeast Quarter of Section 28, Township 18N., Range 06 W. W.M. within Grays Harbor County, WA.

The environmental impacts of the proposal have been reviewed as required under the Washington State Environmental Policy Act (SEPA), and a Mitigated Determination of Non-significance (MDNS), dated February 7, 2008, has been issued for the proposal. All interested person or agencies are invited to comment on this environmental threshold determination. Contact the Grays Harbor County Planning Division to register comments, obtain copies of the SEPA Checklist, or to request information on the appeal procedure. Ordinance No. 1429

AN ORDINANCE governing the installation and control of cross- connections with the potable water system of the City of Westport, repealing Section 13.04.190, WMC in its entirety and replacing it with new language, and amending Ordinance 536.

WHEREAS, it is the responsibility of the City of Westport to provide water to the customer at the meter that meets Washington State water quality standards, and

WHEREAS, Cross-connections within the customer’s plumbing system pose a potential source for the contamination of the public water supply system, and

WHEREAS, the City of Westport has adopted a Cross Connection Control (CCC) Program by Resolution #733 which establishes a service policy to protect the City’s water system from the risk of contamination;

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF WESTPORT, WASHINGTON DOES ORDAIN AS FOLLOWS:

13.04.190 Cross-connections.
(1) The permitting, regulation and elimination of cross-connections shall be in accordance with the City of Westport’s Cross Connection Control (CCC) Program dated November 29, 2007 as it currently exists or is hereinafter amended.
(2) The installation or maintenance of a cross-connection or possible cross-connection which would endanger the water quality of the potable water system of the city is prohibited. Any such cross-connection now existing is a nuisance and shall be abated immediately in accordance with the City of Westport’s CCC program.
(3) Services from the city’s water system to any premises upon which a private water supply system is used or operated contrary to the provisions of the City of Westport CCC Program may be discontinued or refused.
(4) Furnishing of service shall be contingent upon the customer complying with the provisions of the City of Westport’s CCC program, including providing cross-connection control if required for the protection of the city water system from backflow.

AN ORDINANCE REVISING THE USE OF CERTAIN REVENUES IN THE SEWER RESERVE FUND AND REPEALING ORDINANCE #1260.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WESTPORT AS FOLLOWS:

There is a separate line item in the Sewer Reserve Fund #492 for the purpose of updating the Sewer Comprehensive Plan. The maximum accumulation under this section will be $60,000.
There is a separate line item in the Sewer Reserve Fund #492 for the purpose of upgrades to the Wastewater Treatment Plant.
There is a separate line item in the Sewer Reserve Fund #492 for the RDA Bond requirements.
All revenue transferred into the sewer reserve fund #492 will be according to the appropriated sewer budget based on actual availability of funds to be transferred.
Council authorization is required to expend funds from the Sewer Reserve Fund.
Ordinance #1260 is hereby repealed in its entirety.
The effective date of this ordinance is January 15, 2008.

DETERMINATION OF NONSIGNIFICANCE

WAC 197-11-970 Determination of Nonsignificance (DNS).

Description of proposal: Project includes construction of a boatlift dock facility at the Westport Marina in Westport, WA in Section 1, Township 16 North, Range 12 West W.M. The proposed facility will require removal of existing finger floats along Floats 17 and 19 as the new boatlift dock will be located between these two floats. The boatlift system includes one new access floating dock adjacent to Float 17. Floats 17 and 19 existing piling, walers, and hardware will be replaced with steel piling and timber walers.

Project work includes:
Removal of 26 finger floats and tri-frame connections on Floats 17 and 19 with a total area of 4,584 square feet removed.
Removal and disposal of 40 creosote-treated timber and 4 steel pilings with average diameter of 12 inches on Floats 17 and 19.
Installation of thirty-nine 18-inch diameter steel piling on Floats 17 and 19.
Installation of lift boat dock, which is comprised of 4,290 square feet of deck area supported by 24 pile caps. Each pile cap will have two 24-inch diameter concrete or steel piling, with a total of forty-eight 24-inch diameter piling.
Installation of one lift boat access floating dock, 6 feet by 136 feet for a total of 816 square feet of float. This includes six 18-inch diameter steel piling for the dock and two 12-inch concrete piling for the access trestle.

WHEREAS, the filing fee at Grays Harbor County has increased substantially, and

WHEREAS, the City needs to recover its cost in review of Boundary Line Adjustment applications.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WESTPORT, WASHINGTON, AS FOLLOWS:

Section 1. Fees Established.
Section 17.56.040 Fees Established. The Boundary Line Adjustment fee shall be $150.00

Section 2. Severability.
The provisions of this ordinance are hereby declared to be severable. If any portion of this ordinance is adjudged by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance.

Section 3. Effective Date.
This ordinance shall be in full force and effect upon its passage, approval and publication in the manner required by law.
